AI In Employment Decisions per the Illinois Human Rights Act
The Illinois Human Rights Act, as amended by Public Act 103-0804, prohibits discriminatory use of Artificial Intelligence (AI) in employment.
Use of AI in employment must comply with current policies on hiring, nondiscrimination, information security, and privacy. University of Illinois departments and/or hiring units must consult with relevant Human Resources, Access and Equity, and Information Technology offices before making any AI-related purchasing or implementation decisions.
All job advertisements must include the following language:
Artificial Intelligence (AI) tools may be used in some portions of the candidate review process for this position; however, all employment decisions will be made by a person.
AI may be used as a tool during the hiring process, but all employment decisions must be made by a person.
The use of predictive data analytics in employment decisions should not consider protected characteristics that result in discrimination. This includes, but is not limited to, using zip codes as a proxy for race.
Artificial Intelligence Video Interview Act
The Artificial Intelligence Video Interview Act (820 ILCS 42) mandates that employers disclose to applicants if they are using AI in video interviews, explain how the AI works/evaluates applicants, obtain their consent before the interview, and delete video when requested.
Hiring units or search committees must do the following if they utilize AI tools to analyze videos. These steps must be taken before asking applicants to submit video interviews:
- Notify each applicant before the interview that artificial intelligence may be used to analyze the applicant's video interview and consider the applicant's fitness for the position.
- Provide each applicant with information before the interview explaining how artificial intelligence works and what general types of characteristics it uses to evaluate applicants.
- Obtain, before the interview, consent from the applicant to be evaluated by the artificial intelligence program as described in the information provided. The consent must be in writing.
